The federal appeals court has upheld a ban on sending state troops in the Oregon city, after a latest legal decision.

Judicial Panel Concurs to Reconsider Case

The federal appeals court decided on Tuesday that it would rehear the case concerning the executive power with an expanded group of 11 judges. The court also vacated a previous ruling from a three-judge panel that had sided with the federal government.

Legal Saga Over Troop Deployment

This legal directive represents the most recent turn in a long-running court case over whether the former president has the legal right and justification to deploy national guard forces in Portland. Approximately two hundred troops have been in uncertainty since late September when the mobilization attempt was initiated in due to months of protests.

Differing Viewpoints

The federal government has claimed that government employees at the ICE facility in the southern part of the city were facing threats, while local authorities maintain that local officers have control of the circumstances.

In defiance of characterizations of the city as “war ravaged”, locals have been sharing videos of lush hiking trails and a thriving food scene, and planning activities such as an protest bicycle event against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a federal judge in Portland issued two legal injunctions this month – one preventing the federal control of the Oregon national guard, and another prohibiting the use of any national guard troops in Oregon, after attempts to evade the initial injunction by mobilizing troops from California.

On the previous day, the appeals court had temporarily suspended the initial decision – allowing control of state troops – but the second ruling remained in place, preventing the physical sending of the troops.

Full Panel Consideration

The latest ruling means the matter will be heard “en banc” – with all decisions under consideration together – by a panel of eleven justices.

“This ruling demonstrates that the truth matters and that the judicial system are striving to ensure government responsibility. The founding document restricts the president’s power, and local populations cannot be treated as a training ground for expansive government power,” stated the legal representative in a official comment.

“The judicial body is sending a definite signal: the executive leader cannot dispatch the armed forces into US cities without cause. We will continue defending Oregon’s laws, values, and sovereignty as this case moves forward and our fight continues in the judicial system.”
